ORDER
Mrs. S. Mythreye Chandru, learned Special Government Pleader (Education) takes notice for respondents 1 & 2 and Mr.C. Kathiravan, learned counsel takes notice for the 3rd respondent. . By consent of both the parties, this writ petition is taken up for final disposal at the admission stage itself.

It is stated that the petitioner completed SSLC in the year 2006 and thereafter joined B.A. Degree course in the same year as that relevant point of time, candidates were permitted to pursue courses like that of nature. It is further stated that he completed H.Sc in the year March 2009 as well as completed B.A. (History) Degree course in December 2009 at Annamalai University. Subsequently, he completed B.Ed course in the year 2013 and also completed M.A. History in the year 2015.
3. It is further stated that pursuant to the recruitment notification issued by the 3rd respondent / TRB for the post of B.T. Assistant (Graduate Teacher), 2/6
the petitioner applied, appeared for the examination, secured 89 marks including weightage, and was called for certificate verification. No objection was raised at any stage regarding his educational qualifications. The petitioner's name was included in the provisional as well as revised provisional selection lists at Serial No.188 and he was allocated to the Directorate of School Education. He also participated in counselling conducted by the 2nd respondent on 03.09.2025 and selected a school in Nagapattinam District.

It is the grievance of the petitioner that though the petitioner's name was included in the training candidates list along with other BT Assistants, he was not issued with an appointment order and was orally informed that his candidature was withheld on the ground that he had completed Higher Secondary and UG degree in the same year, without any written order being passed. In such circumstances, this writ petition has been filed with the aforesaid prayer.

Learned counsel for the petitioner submitted that during the relevant period, candidates were permitted to pursue degree courses without completing higher secondary course and the rules prevalent were not framed at that point of time and further submitted that rule cannot be given effect retrospectively. 3/6
Therefore, she contended that the qualifications acquired by the petitioner are permissible and valid. She vehemently argued that much prior to the passing of G.O. Ms. No.107, dated 18.08.2009, the petitioner completed higher secondary and degree courses. In view of the above, she prayed for issuance of appropriate directions by this Court.
6. Learned Special Government Pleader appearing for the respondents 1 and 2 submitted that the petitioner has not completed the conventional 10 + 2 + 3 pattern of education. However, she fairly submitted that since the petitioner was provisionally selected, the 1st respondent has already sought clarification from the 3rd respondent /TRB by forwarding a proposal dated 16.12.2025 and immediately upon receipt of clarification, appropriate orders will be passed.
7. Learned counsel appearing for the 3rd respondent submitted that necessary clarification sought for by the 1st respondent will be issued within a time frame to be fixed by this Court.
8. Recording the above submissions, this Court, without expressing any opinion on the merits of the rival contentions, directs the 3rd respondent to issue 4/6
necessary clarification on the proposal dated 16.12.2025 submitted by the 1st respondent, on or before 05.01.2026. Upon receipt of such clarification, the 1st respondent is directed to communicate the same to the petitioner within a period of one week thereafter. However, liberty is granted to the petitioner to work out his remedy in the manner known to law.
