ORDER

This criminal original petition is filed seeking to set aside the order dated 19.11.2025 passed in E.Crl.M.P. No. 6265 of 2025 by the learned Judicial Magistrate No.III, Tiruppur, by which the application filed by the petitioner to modify the condition imposed while granting bail came to be dismissed. 2.

Learned counsel for the petitioner submitted that the petitioner was arrested by the respondent Police on 07.11.2025 in Crime No. 24 of 2024 for the offences under Section 420 IPC and Section 66D of IT Act and the learned Judicial Magistrate No.III, Tiruppur, on the very same day, granted bail to the petitioner on his executing own bond with a condition that he shall report before the respondent Police everyday at 9.00a.m. until further orders. Learned counsel for the petitioner further submitted that the petitioner is a resident of Coimbatore and he is suffering from Grade III internal hemorrhoids. Therefore, he was unable to travel to Tiruppur everyday to comply with the condition, which necessitated the filing of the petition in E.Crl.M.P. No. 6265 of 2025 to modify the condition imposed. However, the learned Judicial Magistrate No.III, Tiruppur, dismissed the said petition. Hence, the present criminal original petition.

Per contra, learned Government Advocate (Crl.Side) submitted that the investigation is at the initial stage and the presence of the petitioner is required by the respondent Police.

Taking into consideration the fact that investigation is pending and also the fact that the petitioner is suffering from Grade III internal hemorrhoids, this Court is inclined to modify the condition imposed by the learned Judicial Magistrate No.III, Tirupppur. Accordingly, the condition imposed on the petitioner to report before the respondent Police everyday at 9.00a.m. is modified to the effect that he shall report before the respondent Police every Monday at 10.30 a.m. until further orders.
