ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections123 of BNS, 2023 in Crime No. 2 of 2026, on the file of the respondent Police, seeks anticipatory bail. 1/4

2. The allegation against the petitioner is that the petitioner, who is ranked as A4 in this case, joined hands with three other accused and illegally procured the 153 Tapentadol tablets from Pune (Maharashtra) and sell them at various places. In this regard, A1 to A3 were arrested.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated based on the confession statement recorded from the arrested accused in this case. He submits that the petitioner is not having any previous case. He also submits that the petitioner is ready to abide by any conditions that may be imposed by this Court and ready to furnish sufficient solvent sureties for his release. Hence, he prays for grant of anticipatory bail to the petitioner.

The learned Government Advocate (Criminal side) for the respondent police, reiterated the prosecution case and submitted that 153 Tapentadol tablets have been misused for intoxication and sold to various college students, school going students, and others. He further submitted that the petitioner had paid Rs.20,000/- to A2 for the purpose of procuring 3 bags. He further submitted that the investigation is pending, and he opposed to grant anticipatory bail to the petitioner. 2/4

Considering the nature of allegations and the fact that the petitioner transported 6 bags of Tapentadol tablets, and further, it is stated that the Tapentadol tablets have been misused for intoxication and sold to college students and school going students, this Court is not inclined to grant anticipatory bail to the petitioner.
