A.Nos.607 & 608 of 2026 in CS.DR.No.174423 of 2025 MASTER 16.02.2026 COMMON ORDER

1. There are two applications filed by the applicant. A.No.607 of 2026 is filed to condone the defect in presentation of CS.DR.No.174423 of 2025. A.No.608 of 2026 is filed to condone the delay of 17 days in paying the deficit court fee of Rs.10,400/- of CS.DR.No.174423 of 2025.

2. The reason stated for the defective presentation A.No.607 of 2026 is that due to inadvertence failed to obtain attestation from the Assistant Registrar. The reason stated for the delay in paying the deficit court fees is that due to inadvertance the court fee was not paid for the entire relief.

3. Now the point to be decided is that whether these applications are to be allowed or not?

Though this Court is not completely satisfied with the reason stated in the affidavit considering the fact that the applicant has paid substantial court fees at the time of filing this court is inclined to allow these applications.
