This application has been filed to condone the delay of 795 days in receiving the written statement filed by the third defendant.

2. According to the applicant, he is the third defendant in the main suit. He was suffering from certain unforeseen health ailments, and thereby he was unable to file the written statement. Hence, a delay of 795 days occurred in filing the written statement.

3. The other side has not filed any counter and they have no objection in allowing this application.
