PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, pleased to issue a Writ of Mandamus, directing the respondents 1 to 4 to consider the petitioner's representation dated 15.07.2024 and 10.10.2025 with regard to cancellation of settlement deed dated 23.02.2022 vide Document No.5920/2022 on the file of SRO, Selaiyur executed by the petitioner in favour of 5th respondent.

ORDER
After submitting representations dated 15.07.2024 and 10.10.2025 seeking cancellation of settlement deed dated 23.02.2022, the present writ petition has been filed.
2. The petitioner asserts that she executed settlement deed dated 23.02.2022, which was registered as Document No.5920 of 2022, in favour of the 5th respondent, who is her son. After the said document was executed, 2/5
it is stated that the 5th respondent has failed to take care of the petitioner. In those circumstances, after issuing the representations referred to above, the present writ petition has been filed.
3. Learned Special Government Pleader accepts notice for respondents 1 to 4. He points out that the settlement deed records expressly that the settlor does not have power to cancel the same.
4. Upon examining the settlement deed, it is noticeable that the petitioner has not made the settlement on condition that the 5th respondent provides for and takes care of the petitioner. In those circumstances, a mandamus as prayed for cannot be issued. However, it is open to the petitioner to seek any other remedies under The Maintenance and Welfare of Parents and Senior Citizens Act, 2007.
