ORDER
The petitioner apprehends arrest for the alleged offence under Sections 140(1) and 103(1) of BNS., in Cr.No.493 of 2025, on the file of the respondent police seeks anticipatory bail.

2. The prosecution case is that the deceased, Gokul, was suspected to have acted against the interest of one Murugesan (A1). With a view to attacking him, this petitioner, along with the other accused, conspired and abducted the deceased from a tea shop on 16.11.2025. Thereafter, they assaulted him severely, confined him at another place, and subsequently took him to a forest area, where they attacked him with a wooden log and caused his death. After committing the murder, they dumped his body in a lake at Puttur Village, which led to the registration of the FIR. Hence, the present case.
3. The learned counsel for the petitioner submitted that the petitioner herein is only a driver by profession and that he was called by A1 merely to drive the vehicle to various places. It is contended that he was only a paid driver and was not aware of the alleged attack on the deceased. According to the learned counsel, the situation appeared normal while the deceased was in the vehicle, and the petitioner was unaware of what transpired inside the forest area. Therefore, he prayed for grant of anticipatory bail.
5. Per contra, the learned Government Advocate (Crl. Side) reiterated the prosecution case and submitted that initially a man-missing case was registered. Subsequently, the body was found near the lake, and the case was altered into one of murder. Further investigation revealed that this petitioner, 2/4
along with the other accused, abducted the deceased, assaulted him severely, committed his murder, and dumped his body in the lake. She also produced copies of the statements recorded from the witnesses and the arrested accused.
6. I have perused the materials available on record, which reveal that the petitioner not only drove the vehicle at the request of A1, but also actively participated in the conspiracy and assaulted the deceased. Hence, I am not inclined to grant anticipatory bail to the petitioner.
7. Accordingly, this Criminal Original Petition is dismissed. 17.12.2025 Vv To
