Prayer : Petition filed under Article 226 of the Constitution of India seeking a writ of Declaration declaring Section 2(d) of the Tamil Nadu Act 40 of 2010, as amended by Tamil Nadu Act 35 of 2020 as null and void insofar as it restricts the benefit of the Persons Studied in Tamil Medium Act, 2010 who pursued the qualification for the direct employment in a medium other than Tamil since such course is not offered in Tamil medium.

ORDER

(Order of the Court was made by the Hon'ble Chief Justice) Heard on admission. The following relief has been sought in the writ petition:

i) Stay all the selection process under the impugned notification i.e., notification-no. 17/MRB/2025 dated: 21.11.2025 issued by the 4th Respondent till the disposal of the writ and thus render justice. ii) direct the respondents to extend the benefits by way of constructive interpretation of the Persons Studied in Tamil Medium Act, 2010 and offer employment for those who have completed their studies from 1st to 12th

standard in Tamil medium and further pursued their Diploma, Under Graduate and Post Graduate studies in English, where that courses are not offered in Tamil pending disposal of the above main writ petition and pass such further or other orders that this Hon'ble Court may fit and proper in the circumstances of the above case and thus render justice.

iii) Issue a writ or order or direction more in the nature of a Writ of Declaration, declaring Section 2(d) of the Tamil Nadu Act 40 of 2010, as amended by Tamil Nadu Act 35 of 2020 as null and void insofar as it restricts the benefit of the Persons Studied in Tamil Medium Act, 2010 who pursued the qualification for the direct employment in a medium other than Tamil since such course is not offered in Tamil medium and pass such further or other orders that this Hon'ble Court may fit and proper in the circumstances of the above case and thus render justice.

2. Learned counsel for respondents, at the outset, refers to two orders passed by the Division Bench of this Court and also the order of the Supreme Court and submit that the issue raised is now concluded and no longer res integra.

3. We have gone through the order dated 22.03.2021 passed by Division Bench of this Court in W.P.(MD) No.8025 of 2020 and also the order passed thereafter in another writ petition in W.P.No.2401 of 2022 on 13.06.2022.

4. The order dated 22.03.2021 passed in W.P.(MD) No.8025 of 2020 was challenged before the Supreme Court also, where, validity of Section 2(d) of the Tamil Nadu Appointment on Preferential Basis in the Services under the State of Persons studied in Tamil Medium Act, 2010 was upheld affirming the judgment of the High Court. Therefore, there is no merit in this petition. Accordingly, it is dismissed. There shall be no order as to costs. Consequently, the interim applications are also dismissed.
