ORDER
The petitioner, who was arrested and remanded to judicial custody on 29.10.2025 for the alleged offence under Section 8(c) r/w. 22(b) of the NDPS
Act in Crime No.266 of 2025 on the file of the respondent police, seeks bail.
2. The allegation against the petitioner is that the petitioner/A1 was found in possession of 3.20 grams of Methamphetamine which is scheduled drug under the NDPS Act. Hence the petitioner was arrested.
3. The learned counsel appearing for the petitioner submitted that the contraband seized in this case is only intermediate quantity and it was in his possession for the purpose of his personal consumption. He further submitted that he is willing to abide by any stringent conditions that may be imposed by this Court. Hence, he prays to grant bail to the petitioner.
4. The learned Government Advocate (Criminal Side) appearing for the respondent Police reiterated the prosecution case and submitted that the petitioner is a habitual offender, and he has 6 previous cases, out of which two cases are of similar nature, and if the petitioner is granted bail, he will indulge in similar activities. Hence, he opposed to grant bail to the him.
5. I have gone through the list of previous cases and the facts of this case; it is revealed that the petitioner was in possession of intermediate quantity,
and he cannot claim that it is used for self consumption and further petitioner is having previous cases, hence, this Court is not inclined to grant bail to the petitioner.
