This Criminal Original Petition has been filed to direct the learned Judicial Magistrate No.I, Kallakurichi to dispose of the case in S.T.C.No.160 of 2022 within the time fixed by this Court.

2. The learned counsel appearing for the petitioner would submit that the petitioner is the defacto complainant in this case and the occurrence is of the year 2020 and the case is of the year 2022. He would further submit that out of 12 witnesses, 5 witnesses have been examined so far and fresh summons have been issued to other witnesses, the accused is willfully delaying the trial.

3. The learned Government Advocate [Criminal Side] appearing for the first respondent would submit that out of 12 witnesses 5 witnesses have been examined in chief. However, the accused has not cross-examined them. He would further submit that the case stands posted to 06.01.2026 for examination of further witnesses.

4. Considering the submissions of either side and taking note of the fact that the occurrence is of the year 2020 and final report has been 2/4

filed in the year 2022, the learned Judicial Magistrate No.I, Kallakurichi is directed to dispose of the case in S.T.C.No.160 of 2022, as expeditiously as possible, preferably within a period of six months from 06.01.2026.

5. With the above direction, this Criminal Original Petition is disposed of.
