ORDER

This petition has been filed for quashing the Domestic Violence Application in MC.No.03 of 2016 pending on the file of the Judicial Magistrate-III, Pondicherry.

2. When the matter is taken up for hearing today, Learned counsel for the petitioner seeks permission of this Court to withdraw this petition, in view of the order of dismissal passed by this Court in Criminal O.P. No. 28458 of 2019 on 18.1.2021, wherein it has been held that no criminal original petition is available as against the DVC proceedings, only Cr.P.C. is available. A copy of the order dated 18.01.2021 has also been produced, which is placed on record.

Recording the said submission and order produced, this Criminal Original Petition is dismissed granting liberty to the petitioner to work out their remedy, if they are aggrieved, before appropriate forum in the manner known to law.
