Mr.M.Vaidhiyanathan, Standing Counsel Order This writ petition is filed for the following relief: "To issue a Writ of Mandamus, directing the respondents 1 to 3 herein to admit the petitioner's twin daughter A.E. Eniya aged 6 years to Balwadika -3 in Tambaram, Kendriya Vidyalaya -1 at AFS Tambaram, Chennai Region, Madambakkam Camp, Tambaram East, Selaiyur Post, Chennai- 600 073 by considering her application for admission and the representations dated 21.04.2025, 30.04.2025 and 27.11.2025 made by the petitioner by speed post within a time frame to be fixed by this Court."

2. It is the case of the petitioner that he is blessed with twins a son, A.E.Eniyan and a daughter, A.E.Eniya. He had applied for admission to Balwadika-3 at Tambaram, Kendriya Vidyalaya. While the petitioner's son had secured admission, his daughter, the other twin, was not admitted to the 3rd respondent school. The petitioner has set out the difficulties faced by the twins

on account of their separation and the woes of the parents in having to follow two different curricula. Therefore, the petitioner has come forward with the present writ petition.

A counter affidavit has been filed by the 2nd respondent in which it is contended that 1052 applications were received for admission to Balavatika-3 for the academic year 2025-2026, of which 415 applications were found eligible for consideration under the RTE quota. The category-wise details of the applications have been set out in the counter affidavit. It is further contended that out of 40 seats that were available for admission, 25% i.e 10 seats are reserved for candidates under the RTE quota. The sequence for fresh admission to Balvatika-3 has been set out in paragraph 6 of the counter affidavit. After following the prescribed procedures, the petitioner's son, Eniyan, was placed at wait-list No.3 in the RTE category and was subsequently admitted. The petitioner's daughter, Eniya, was placed at wait-list No.53. Since there were 49 candidates placed above her in the wait-list, the respondents have clearly stated that the chances admitting the daughter of the petitioner is rather slim.

4. The learned counsel for the petitioner had produced the guidelines for admissions wherein special provisions have been set outin Part B Clause VIII which reads as follows:

VIII. Single girl children in class I and from class VI onwards subject to a maximum of two per section in class I and two per class in class VI and onwards. It includes twin girl children also.

a) In case of twin girls, it will be treated as one admission. b) While drawing the lot, name of both girls (twin) should be written on a single slip / inter linked.

c) In case of single girl child (including twin girl children) if number of applications are more than the number of allotted seats i.e maximum of 02 per section in Class I and 02 per class in class VI and onwards, the admission should be granted on the basis of the Priority Category. If in one category more applications are made, all such applications should be taken together and the list of selected candidates should be prepared through draw of lots.

Therefore, he would contend that the petitioner's daughter is entitled to admission.

Heard the learned counsel on both sides and perused the materials available on record.

6. The respondents, in their counter affidavit, clearly detailed the seat matrix and the proceedures followed in granting admission. The petitioner's son, who was placed at Serial Number No.3 in the wait-list, had secured admission. However, the daughter, who had secured lower marks, was wait-listed at No.53 and there are 49 candidates ranked above her. The guidelines which has been referred to by the learned counsel for the petitioner relate to cases where both twins are girls and do not apply to a case where one of the twin is a boy. Therefore, the contention that the petitioner's daughter is entitled to admission by invoking the said guideline cannot be accepted.

7. Therefore, in the light of the above discussion, the request of the petitioner cannot be acceded to and consequently, the writ petition is dismissed. No costs.
