To grant an interim stay of all further proceedings in H.M.O.P.No.70 of 2025 on the file of the Family Court, Karaikkal, pending disposal of the above Tr.C.M.P.

ORDER

1. Heard.

2. This Transfer Civil Miscellaneous Petition is filed under Section 24 of the Code of Civil Procedure to withdraw and transfer H.M.O.P.No.70 of 2025 pending on the file of the Family Court, Karaikkal to the file of the Sub Court, Tambaram, to be tried along with O.P.No.421 of 2025 pending before the Sub Court, Tambaram.

3. The marriage between the petitioner and the respondent was solemnized on 20.10.2023 at SLM Marriage Hall, Ammal Chatram, Nagoor Salai, Karaikkal as per Hindu rites and customs.

4. The petitioner is the wife and she is residing within the Tambaram/Chennai jurisdiction. The petitioner has filed O.P.No.421 of 2025 at Tambaram seeking matrimonial reliefs. The respondent/husband has filed H.M.O.P.No.70 of 2025 at Karaikkal seeking restitution of conjugal rights.

It is submitted that the petitioner is residing at Tambaram, and the divorce petition filed by her is at the stage of appearance of the respondent, whereas the proceedings for restitution of conjugal rights are at the stage of filing counter. In the circumstances, it would be appropriate that both proceedings are tried by the same Court, to avoid multiplicity and for effective adjudication.

6. Accordingly, Tr.C.M.P.No.1383 of 2025 is allowed. The proceedings in H.M.O.P.No.70 of 2025 on the file of the Family Court, Karaikkal are withdrawn and transferred to the file of the Sub Court, Tambaram, to be

tried along with O.P.No.421 of 2025. The learned Judge, Family Court, Karaikkal, is directed to transmit the entire records in H.M.O.P.No.70 of 2025 to the learned Sub Judge, Tambaram, within three weeks from the date of receipt of a copy of this order. The Sub Court, Tambaram shall dispose of the matter in accordance with law, as expeditiously as possible, uninfluenced by any observations made in this order. Consequently, connected C.M.P.No.32412 of 2025 is closed. There shall be no order as to costs.
