ORDER
This Writ Petition has been filed to direct the 2nd respondent to cancel UDR patta presently standing in the name of the 4th respondent for the property morefully described in the prayer to this writ petition, within a time frame to be fixed by this Court.
2. The petitioner claims that pursuant to UDR survey, erroneously UDR patta has been issued in favour of the 4th respondent for the property morefully described in the prayer to this writ petition. The petitioner seeks for cancellation of the said patta standing in the name of the 4th respondent and he has given a representation dated 16.06.2025 to the official respondents for the said purpose. Since the same has not been considered till date, the petitioner has filed this writ petition.
3. Mr.D.Ravichander, learned Special Government Pleader, accepts notice on behalf of the respondents 1 to 3 and he would submit that the petitioner's representation will be considered on merits and in accordance with law, after hearing the objections of the 4th respondent and any other party, whom the 2nd respondent deems fit to enquire. 4. Since no adverse order is being passed against the 4th respondent, notice to the 4th respondent is dispensed with.
5. No prejudice would be caused to the respondents, if the petitioner's representation as stated supra is considered on merits and in accordance with law, after hearing the objections of the 4th respondent as well as any other party, whom the 2nd respondent deems fit to enquire, within a time frame to be fixed by this Court. This Court is not expressing any opinion on the merits of the petitioner's representation.
6. For the foregoing reasons, this Court directs the 2nd respondent to pass final orders on merits and in accordance with law on the petitioner's representation dated 16.06.2025 seeking cancellation of UDR patta presently standing in the name of the 4th respondent for the property morefully described in the prayer to this writ petition, after hearing the objections of the 4th respondent as well as any other party, whom the 2nd respondent deems fit to enquire, within a period of twelve (12) weeks from the date of receipt of a copy of this order. 7. With the aforesaid directions, this Writ Petition is disposed of. No costs.
