The Tahsildar Tahsildar Office Nallampalli Taluk Dharmapuri District ..Respondents Writ Petition filed under Article 226 of Constitution of India for issuance of Writ of Mandamus, directing the respondents to give succession certificate (Legal Heir Certificate) on the basis of petitioner's representation dated 20.10.2025.
For Petitioner : Mr.M.Saravanakumar For Respondents : Mr.Yogesh Kanndasan Special Government Pleader
ORDER
This writ petition has been filed seeking a direction to the respondents to give succession certificate (Legal Heir Certificate) on the basis of petitioner's representation dated 20.10.2025. 1/4
2. The case of the petitioner is that she applied for legal heir/succession certificate on 05.08.2025 on account of death of her son viz., Rangasamy, but the said application was rejected based on the objection raised by her daughter-in-law. Hence, the petitioner sent a representation on 20.10.2025, but till date no action has been taken on the said representation. Hence, the present writ petition.
3. Mr.Yogesh Kannadasan, learned Special Government Pleader, who accepted notice on behalf of the respondents, submitted that the legal heir certificate will be issued as per the guidelines issued in G.O.Ms.No.478 dated 29.09.2022.
4. Admittedly, the petitioner is a Class I legal heir along with her daughter-in-law and grandchildren. Such being the position, merely because there was an objection raised by other legal heirs, the legal heir certificate cannot be denied.
5. Therefore, the respondents are directed to consider the application of the petitioner and issue legal heir certificate. If the application of the petitioner is not received by the respondents, the petitioner is at liberty to make a fresh application within a period of two weeks from the date of receipt of a copy of this order. Upon receipt of such application, the respondents are directed to issue a legal heir certificate to the Class I legal 2/4
heirs within a period of one month thereafter. This writ petition is disposed of with the above direction. There shall be no order as to costs.
