O R D E R

This Writ Petition has been filed challenging the order dated 19.03.2025 passed by the respondent, suspending the petitioner from his service, quash the same and further direct the respondent to consider the petitioner's representation dated 24.10.2025 and review the order of suspension and reinstate the petitioner into her service, with all service benefits.

2. With the consent of the learned counsel appearing on either side, this Writ Petition is taken up for disposal at the admission stage.

The learned Senior Counsel appearing for the respondent would submit that the DVAC registered a criminal case under Section 7 of the Prevention of Corruption Act as against the petitioner and arrested him on 19.03.2025 and remanded to judicial custody on the same day at 4.30 p.m. However, without completing 48 hours, the respondent passed a suspension order on 19.03.2025. However, till date, the prolonged suspension was not revoked by the respondent thereby, the present writ petition is filed.

Learned Senior Counsel appearing for the petitioner would submit that though the suspension order was passed within 48 hours, which is not permissible one, the public interest for suspending the petitioner is not revealed in the suspension order. On the above said ground, he seeks revocation of suspension order. The learned Senior Counsel appearing for the petitioner would submit that however, the petitioner has not been released before 48 hours, he was confined in the Puzhal prision after 48 hours and for revocation of suspension order, the petitioner already made a representation on 24.10.2025 on the ground of prolonged suspension hence, this Court may issue a direction to the respondent to consider the representation of the petitioner and pass appropriate orders.

5. Learned Special Government Pleader appearing for the respondent would submit that the respondent will consider the representation of the petitioner and pass appropriate orders within a specified time.

6. In view of the same, the respondent is directed to consider the representation of the petitioner dated 24.10.2025 and pass appropriate orders

on the same, in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.

7. This Writ Petition is disposed of with the above terms. No costs. Consequently, connected miscellaneous petition is closed. 18.12.2025 NCC: Yes / No Index : Yes / No Speaking Order : Yes / No kkn
