ORDER

This writ petition has been filed seeking issuance of a writ of mandamus directing the first respondent to expedite the adjudication and disposal of Opposition Nos.1290311, 1290312 and 1290313 filed by the second respondent against the petitioner's trade mark Application Nos.6071366, 6071367 and 6071369 in class 32, 35 and 43, which is pending before the first respondent.

2. Heard Mr.G.Ramesh, learned counsel for petitioner and Mr.K.Subbu Ranga Bharathi, learned Central Government Counsel appearing for respondents.

3. The petitioner claims to be the lawful proprietor of the trademarks " " and "ANAGANAGA" [hereinafter referred to as "ANAGANAGA" and its variants, which was adopted from 08.08.2023. The second respondent claims to be the proprietor of the mark "NAGA" and filed three oppositions for the applications submitted by petitioner. Pleadings are complete and the grievance of the petitioner is that the first respondent is yet to decide the applications filed by petitioner and it is under these circumstances, the present writ petition has been filed. 2/4

Taking into consideration the facts and circumstances of the case and considering the limited relief sought by the petitioner and without going into the merits of the case, there shall be a direction to first respondent to expedite the adjudication of Opposition Nos.1290311, 1290312 and 1290313 filed by the second respondent against the petitioner's trade mark Application Nos.6071366, 6071367 and 6071369 in class 32, 35 and 43 and take a final decision as expeditiously as possible, not later than four (4) months from the date of receipt of a copy of this order.
