O R D E R

This Criminal Original Petition has been filed seeking to quash the First Information Report in Crime No.349 of 2025, on the file of the first respondent Police.

Based on the complaint given by the second respondent/de facto complainant, alleging that the accused had cheated him to the tune of Rs.2,80,000/- and also taken away 25 sovereigns of gold jewels under the guise of converting old jewels into new ones, the first respondent police registered the case in Crime No.349 of 2025, for the offences under Sections 406 & 420 of IPC on 19.09.2025, which is now sought to be quashed. 3.

Learned counsel appearing for the petitioner submitted that the petitioner, who is arrayed as A1 in Crime No.349 of 2025, is an innocent person and that the second respondent/de facto complainant has not filed any material to prove that the jewels were taken by him. He further submitted that the respondent police, without conducting a proper enquiry, registered the case against the petitioner and that the petitioner has no role in the aforesaid offence. Hence, he prayed to quash the First Information Report pending against the petitioner.

Per contra, the learned Government Advocate (Criminal Side) submitted that based on the complaint given by the second respondent/de facto complainant, the present case came to be registered only on 19.09.2025. He further submitted that the grounds raised by the petitioner can be examined only during the course of investigation and only after the investigation, it can be found out whether the petitioner has any role in the 2/5

case. He also submitted that the case is at a nascent stage of investigation and cannot be quashed at the initial stage. He reiterated that the investigation is at still at a preliminary stage and that the case requires a thorough investigation and therefore, this Court cannot interdict the same under Section 482 Cr.P.C. Hence, he objected to quash the case against the petitioner.

Having heard the learned counsel appearing on either side and upon perusal of the materials available on record and taking note of the fact that the case was registered on 19.09.2025 and that the investigation is at a preliminary stage, this Court is not inclined to interfere with the investigation and does not find any merit in this petition to quash the First Information Report.

Accordingly, this Criminal Original Petition stands dismissed. Consequently, the connected miscellaneous petition is closed. However, the first respondent police is directed to conduct the investigation and to file the final report as expeditiously as possible.
