The delay of 132 days in preferring the first Appeal is sought to be condoned.

2. The learned counsel for the respondent fairly states that he has no serious objection for the delay being condoned.

3. Independently, I have also gone through the affidavit in support of the condone delay application, I am satisfied with the petitioner has made out sufficient cause for being entitled to the condonation of delay. Hence, this Civil Miscellaneous Petition is ordered.
