Prayer:- Writ petition filed under Article 226 of the Constitution of India praying for issuance of a writ of Mandamus, directing the Respondents 1 to 4 to prevent the 5th Respondent from installing its cell phone tower at Site No.33-H which is on the southern side adjacent to petitioner's site at Site No. 33-G in Rajiv Gandhi Nagar at S.F.No. 16/1 in Mylampatti Village of Sulur Taluk in Coimbatore District by considering petitioner's representation dated 10.11.2025 and pass such further or other orders as this Hon'ble court may deem fit and proper in the circumstances of the case and thus render justice.

This writ petition has been filed for the following relief:- "directing the Respondents 1 to 4 to prevent the 5th Respondent from installing its cell phone tower at Site No.33-H which is on the southern side adjacent to petitioner's site at Site No. 33-G in Rajiv Gandhi Nagar at S.F.No. 16/1 in Mylampatti Village of Sulur Taluk in Coimbatore District by considering petitioner's representation dated 10.11.2025."

The main grievance of the petitioner is that, despite a resolution having been passed on 01.11.2025 in the Grama Sabha meeting expressing objection to the erection of a cell phone tower in the near vicinity of Mylampatti Village, Sulur Taluk, Coimbatore District, the 5th respondent commenced construction activities for erecting a high-frequency cell phone tower. Objecting to the said activities of the 5th respondent, the petitioner, along with the village residents, made a representation dated 10.11.2025 to respondents 1 to 4. However, the said representation has not been considered to date. Therefore, the petitioner is before this Court.

4. Considering the limited request of the petitioner and also taking note of the fact the petitioner representation dated 10.11.2025 has not been considered to date, the Writ Petition is allowed. The 1st respondent is directed to consider the petitioner's representation dated 10.11.2025 and dispose of the same on merits and in accordance with law, after affording an opportunity of hearing to all the interested parties, within a period of one month from the date of receipt of a copy of this order. No costs.
