ORDER

The petitioner, who was arrested and remanded to judicial custody on 05.06.2025, for the alleged offence punishable under Sections 8(c) r/w. 20(b)(ii) (c) and 25 of the NDPS Act, 1985 in Crime No.180 of 2025 on the file of the

respondent police, seeks bail.

2. The case of the prosecution is that the petitioner along with other accused had transported 21 kgs of ganja, which is of commercial quantity. Hence, the complaint.

3. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He would further submit that the contraband was seized and that the petitioner was arrested and he is in judicial custody from 05.06.2025 and is ready to abide by any conditions that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

4. Learned Government Advocate (Crl.Side) appearing for the respondent police submitted that the petitioner along with other accused had transported 21 kgs of ganja, which is of commercial quantity. He further submitted that there is no previous case against the petitioner and the investigation in this case is pending. Hence, he opposed for grant of bail to the petitioner.

5. Considering the quantity seized from the petitioner 21 kgs of ganja, which is a commercial quantity and the fact that no grounds have been made out to satisfy the twin conditions under Section 37 of the NDPS Act, this court is

not inclined to grant bail to the petitioner. Accordingly, this criminal original petition is dismissed.
