Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus calling for the records relating to order vide Ka.Thu.Na.Ka.No.P5/9765/2024 dated 30.07.2025 on the file of the 3rd respondents, quash the same as illegal, arbitrary, and without jurisdiction, and consequently direct the respondents to revise the petitioners pay scale and extend all applicable service benefits from the date of regularisation, including Selection Grade, Special Grade, pensionary benefits, leave benefits, gratuity, GPF/Spl. GPF, death-cum-retirement benefits, and all other monetary and non-monetary entitlements on par with similarly placed regular employees, together with arrears. ORDER

This writ petition is filed to call for the records relating to order vide Ka.Thu.Na.Ka.No.P5/9765/2024 dated 30.07.2025 on the file of the 3rd respondents, quash the same as illegal, arbitrary, and without jurisdiction, and consequently direct the respondents to revise the petitioners pay scale and extend all applicable service benefits from the date of regularisation, 2/6

including Selection Grade, Special Grade, pensionary benefits, leave benefits, gratuity, GPF/Spl. GPF, death-cum-retirement benefits, and all other monetary and non-monetary entitlements on par with similarly placed regular employees, together with arrears.

2. By consent of both the parties, this writ petition is taken up for final disposal at the admission stage itself.

3. Learned counsel for the petitioners would submit that the petitioners were working as Ayyahas in the Schools of Chennai Corporation. Earlier, their pay was fixed in terms of G.O.Ms.No.246, dated 01.06.2009 and after that, their salary was not re-fixed. Therefore, the petitioners made a representation to the Chennai Corporation for re-fixation of pay, but the same was not paid. Hence, the petitioners have filed writ petition in W.P.No.1360 of 2025, seeking revision of pay scale from 10.06.2009 and pay the differential amount as arrears of pay along with interest. This Court by its order dated 26.06.2025, issued direction to the respondents to consider their representation and pass appropriate orders on merits and in accordance with law. Pursuant to the said order, the third respondent passed impugned 3/6

order dated 30.07.2025. Challenging the same, the petitioners have come forward with the present writ petition.

Learned counsel for the petitioners would further submit that this Court may permit the petitioners to make a fresh representation to the Secretary, Municipal Administration and Water Supply Department for enhancement of pay and payment of arrears, since the third respondent is not a competent authority to re-fix the petitioners pay.

5. Heard the learned counsel for the petitioner and perused the materials available on record.

In view of the above facts and circumstances of the case, without expressing any opinion on the impugned order dated 30.07.2025, this Court grants liberty to the petitioners to make a fresh representation before the Secretary, Municipal Administration and Water Supply Department, seeking revision of pay scale and other applicable service benefits, within a period of four weeks from the date of receipt of a copy of this order. On such receipt, the Secretary, Municipal Administration and Water Supply Department is 4/6

directed to consider the same and pass appropriate orders on merits and in accordance with law.

With the aforesaid direction, this writ petition stands disposed of. No costs.
