ORDER

The petitioner seeks modification of the condition imposed by this Court in Crl.R.C.No.996 of 2025, dated 07.07.2025, while handing over the interim custody of the vehicle seized in connection with Cr.No.25 of 2025 to the petitioner. The condition 6(ii) in the said order reads as follows: "6.(ii) The petitioner shall deposit the original registration certificate of the vehicle with the concerned Magistrate."

Learned counsel for the petitioner would submit that though the order was passed by this Court on 07.07.2025, the petitioner is unable to take the custody of the vehicle, since the Registration Certificate of the vehicle is in the possession of the Financier, who has been impleaded as the second respondent in the Criminal Revision.

3. Though notice has been served on the second respondent and the name has been printed in the cause list, none appeared on its behalf.

4. Heard the learned Government Advocate (Crl. Side) for the first respondent, who submitted that the first respondent have verified and found that the original Registration Certificate of the vehicle is in the possession of the second respondent / Financier.

5. Considering the above facts and since the vehicle is lying idle at the police station, in spite of the order of this Court dated 07.07.2025, this Court is inclined to modify the condition imposed in the said order. Accordingly, the condition shall read as follows:

"6.(ii)The petitioner shall deposit the photocopy of the registration certificate of the vehicle with the concerned Magistrate ".

6. With the above modification, this Criminal Miscellaneous Petition is ordered. All other conditions imposed by this Court shall remain unaltered. 17-02-2026 Index: Yes/No Speaking/Non-speaking order ANU
