PRAYER:-Writ Petition filed under article 226 of the Constitution of India, praying for an issuance of Writ of Mandamus, directing the respondents 1 to 3 to take action as per statement of Zonal Deputy Tahsildar, Tittakudi Taluk, Cuddalore District dated 04.04.2025 for issue a house site patta, within a time to be stipulated by this Court.

ORDER
This writ petition has been filed seeking to direct the respondents 1 to 3 to take action as per the statement of Zonal Deputy Tahsildar, Tittakudi Taluk, Cuddalore District dated 04.04.2025 and issue house site patta in favour of the petitioner, within a time frame to be fixed by this Court. 2.The petitioner claims that he is a landless poor and he is entitled for issuance of house site patta from the 3rd respondent. The land for which the petitioner seeks for patta is now under the possession of 4th respondent Trust. 3.Learned Senior Counsel appearing for the 4th respondent Trust would submit that the patta has already been issued for the subject land in favour of the
4th respondent and the petitioner does not have any locus standi to seek issuance of patta in respect of the 4th respondent's property. 4.However, learned counsel for the petitioner would submit that the petitioner is coming under the category of landless poor and entitled for issuance of free house site patta in his favour for the subject property. Prior to the filing of this writ petition, the petitioner had submitted a representation to the official respondents seeking for issuance of free house site patta for the subject property. Since the same was not considered by the official respondents, the petitioner has filed this writ petition.
5.No prejudice would be caused to the respondents if the petitioner's representation seeking for free house site patta is considered on merits and in accordance with law, after hearing the objections of the 4th respondent and any other third party, whom the 2nd respondent deems it fit to enquire. Since the patta has already been issued for the subject property in favour of the 4th respondent, the competent Authority to decide the petitioner's representation is only the 2nd respondent.
6.This Court is not expressing any opinion on the merits of the respective contentions.
7.Since the earlier representation given by the petitioner in this regard is old one and there is no appropriate acknowledgement for the same, necessarily the petitioner will have to submit a fresh representation to the 2nd respondent. Learned counsel for the petitioner on instruction would submit that the petitioner is willing to submit a fresh application before the 2nd respondent. 8.For the foregoing reasons, the petitioner is directed to submit a fresh representation to the 2nd respondent seeking for cancellation of patta standing in the name of the 4th respondent Trust and for grant of patta in the name of the petitioner for the subject property, within a period of two (2) weeks from the date of receipt of a copy of this order.
On receipt of the said representation within the stipulated time, the 2nd respondent shall pass final orders on merits and in accordance with law, after providing opportunity for the 4th respondent to raise all the objections which includes the right of the petitioner to quash the grant of patta in favour of the 4th respondent, within a period of twelve (12) weeks thereafter.
