ORDER
The petitioners who were arrested and remanded to judicial
custody on 15.11.2025 for the alleged offence punishable under Section 6(4) of TNSC (RDCS) Order 1982 r/w Section 7(1)(a)(ii) of EC Act, in Crime No.255 of 2025, seeks bail.
2. The allegation against the petitioners is that the petitioners joined hands with other accused were involved in the transportation of 4300 kilograms of PDS rice in two vehicles. Hence, the complaint was lodged and the petitioners were arrested.
3. The learned counsel appearing for the petitioners submitted that the petitioners are in judicial custody since 15.11.2025. He further submitted that the petitioners are not having any previous cases against them. Hence, he prayed to grant bail to the petitioners.
4. The learned Government Advocate (Crl.Side) appearing for the respondent reiterated the prosecution case and submitted that there are totally four accused in this case and the petitioners herein are ranked as A1 and A2. He further submitted that the petitioners have no previous cases; that A3 and A4 are absconding and that investigation is still pending. Hence, he opposed to grant bail to the petitioner.
5. Heard both sides and perused the materials available on record including the First Information Report.
6. Considering the submissions made by the learned counsel on either side, the fact that the petitioners are not having any previous case and considering the period of their incarceration, this Court is inclined to grant bail to the petitioners on certain conditions.
7. Accordingly, the petitioners are ordered to be released on bail on her executing a separate bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) each with two sureties, for a like sum to the satisfaction of the learned Judicial Magistrate No.4, Vellore, and on further conditions that:- [a] the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity;
[b] the petitioners shall report before the respondent police daily at 10.30 a.m., for a period of four weeks and thereafter as and when required for interrogation.
[c] the petitioners shall not abscond either during investigation or trial;
[d] the petitioners shall not tamper with the evidence or witness either during investigation or trial; [e] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioners in accordance with law as if the conditions have been imposed and the petitioners released on bail by the learned Magistrate/Trial Court himself, as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560]; [f] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 B.N.S.
