ORDER

This writ petition has been filed seeking issuance of a writ of mandamus directing the first respondent to expedite the adjudication and disposal of opposition filed by the second respondent against the petitioner's trade mark application, which is pending before the first respondent from the year 2016.

2. Heard Mr.Ramesh Ganapathy, learned counsel for petitioner and Mr.G.Mutharasu, learned Standing Counsel appearing for respondents.

3. The trademark "MAXZONE" was conceived and adopted in the year 2009 by petitioner's predecessor in interest. Pursuant to the Assignment Deed dated 21.10.2024, all the rights in respect of the marks along with the related trademarks were duly assigned in favour of the petitioner. In order to bring a change on record, a TM-M dated 14.12.2024 was filed before the Trade Marks Registry. The second respondent seem to have filed Opposition and the same is kept pending by first respondent without adjudication. It is under these circumstances, the present writ petition has been filed by this Court. 2/4

Taking into consideration the facts and circumstances of the case and considering the limited relief sought in this writ petition and also considering the fact that hearing of the opposition under Section 21(4) of the Trademarks Act r/w relevant rules has been kept pending for more than five years, there shall be a direction to first respondent to adjudicate and decide the opposition filed by second respondent in accordance with law and pass final orders within a period of four (4) months from the date of receipt of a copy of this order.
