2.M.Shanmugam Conductor, Employee No.C125470 S/o.V.Muugan .. Respondents On representation of the learned counsel for the petitioner, this case is taken up for settlement before the Lok Adalat. Mr.A.Vinothraj, learned counsel for the petitioner and Mr.M.Murali, Government Advocate for R1 and Mr.S.Sivaskandavarman for R2 are present. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at
a compromise to settle the matter as follows: TERMS OF SETTLEMENT The petitioner, the Management, Metropolitan Transport Corporation (Chennai) Limited., Chennai filed a petition before the Special Deputy Commissioner of Labour, the first respondent herein, seeking approval of the dismissal of the service of the second respondent M.Shanmugam, who was an employee under them. The Special Joint Commissioner of Labour, Chennai, rejected the above petition seeking approval of the dismissal of employee Mr.M.Shanmugam. Aggrieved by the order passed by the Special Joint Commissioner of Labour, the petitioner-Management preferred the above writ petition.
2. During the course of Lok Adalat proceedings, both the parties having initiated negotiation, successfully arrived at a settlement of all the issues arisen in this case, and have filed a joint memo of compromise.
3. The second respondent M.Shanmugam, workman agrees to forego the entire backwages from the date of his removal i.e., from 09.12.2024 to till the date of reinstatement and also agreed to pay the employer PF contribution to the Pension Fund Trust for the non-employment peirod i.e., from the date of his removal (09.12.2024) to till the date of reinstatement.
4. Further, the petitioner/Corporation have also agreed to reinstate the second respondent without backwages with continuity of service and also agreed to pay the employer PF contribution to the Pension Fund Trust for the non-employment period of the second respondent i.e., from the date of his removal (09.12.2024) till the date of his reinstatement.
5. As a result the award is passed hereby in terms of the above
compromise arrived at between the parties. Consequently, the writ petition stands disposed of in terms of the memo of the compromise. No costs. The connected miscellaneous petitions stands closed.
