ORDER

This writ petition has been filed, challenging the order of the first respondent dated 21.07.2025 and seeking a direction to the 2nd respondent to reinstate the petitioner in one of the schools under his administrative educational jurisdictional district, with all attendant benefits. 2.The case of the petitioner is that the petitioner joined service as BT Assistant in the respondent's department on 21.01.2009 and was posted at Government Higher School, Avanam, Pattukottai, Thanjavur District. During the year 2024, he was transferred to Government Higher Secondary School, Valiyur, Trichy District. Earlier, he had worked as Typist in the Revenue Department from 04.01.1995 till 20.01.2009 in a foreign service, without any adverse remarks.

The petitioner was made a scapegoat by falsely implicating him in a criminal case under POCSO Act r/w Juvenile Justice Act. The petitioner denied all the charges in toto and effectively defended himself; however, to no avail, as the domestic enquiry concluded with the charges being held proved. The petitioner was not served with copies of the depositions of the complainant's which prevented him from knowing the real basis on which the enquiry arrived at its findings, thereby depriving him of an opportunity to make an effective defence.

Challenging the said impugned order, the present writ petition has been filed. 3.The learned counsel for the petitioner would submit that as against the order passed by the first respondent, there is an effective appeal remedy available before the Director of School Education. Hence, this Court may permit the petitioner to file an appeal before the Director of School Education within a period of four weeks and may also issue a direction to the Director of School Education to pass appropriate orders as expeditiously as possible.

Considering the limited request made by the learned counsel for the petitioner and without expressing any opinion on the merits of the case, this writ petition stands disposed of, granting liberty to the petitioner to file an appeal before the Director of School Education, within a period of four weeks from the date of receipt of a copy of this order. Upon receipt of the same, the Director of School Education shall pass appropriate orders on merits and in accordance with law, as expeditiously as possible. Consequently, connected miscellaneous petition is closed. No costs.
