ORDER

(Order of the Court was made by the Hon'ble Chief Justice) Heard learned counsel for the parties.

2. Challenge to the legality of the construction allegedly made by the fifth respondent is primarily based on the averment that it is encroaching upon the petitioner's own land. In the absence

of there being any order passed by the statutory authority in the matter, the petitioner's remedy lies in filing suit.

3. The writ petition is dismissed, with the liberty aforesaid. There shall be no order as to costs.
