Kaliappan and further direct the 2nd respondent to issue a separate patta in the petitioner name with respect of 38 cents of land situated at Natthahalli village and post, nalalmpalli Taluk, Dharmapuri District, bearing Survey no 217/2A1 and 217/2A3, forming part of the larger extent of 1.15 acres, in pursuance of the validly executed and registered Settlement Deed vide Doc no 3374/ 2018 dated 17.09.2018 on the file of the sub Registrar, nalalmpalli, Dharmapuri District.

ORDER

This writ petition has been filed seeking for a direction to the first respondent to cancel the existing joint patta standing in the names of a)Krishnan; b)Mani; and c)Kaliappan for the properties morefully described in the prayer to this writ petition.

2.The petitioner also seeks for issuance of separate patta in his name subsequent to the cancellation of patta standing in the names of a)Krishnan; b)Mani; and c)Kaliappan. The petitioner has given a representation on 19.08.2025 to the respondents for the said purpose. Since the same has not been considered till date, the petitioner has filed this writ petition. 3.Mr.D.Ravichander, learned Special Government Pleader accepts notice on behalf of the respondents.

4.No prejudice would be caused to the respondents if the petitioner's representation dated 19.08.2025 seeking for cancellation of patta standing in the names of a)Krishnan; b)Mani; and c)Kaliappan is considered, on merits and in accordance with law, after hearing the objections of a)Krishnan; b)Mani; and

c)Kaliappan and any other third party whom the first respondent deems it fit to enquire within a time frame to be fixed by this Court. 5.This Court is not expressing any opinion on the merits of the petitioner's representation.

6.For the foregoing reasons, this writ petition is disposed of by directing the first respondent to pass final orders, on merits and in accordance with law on the petitioner's representation dated 19.08.2025 seeking for cancellation of the existing joint patta for the properties morefully described in the prayer to this writ petition, which is now standing in the names of a)Krishnan; b)Mani; and c)Kaliappan, after hearing the objections of a)Krishnan; b)Mani; and c)Kaliappan and also any other third party whom the first respondent deems it fit to enquire within a period of 12 weeks from the date of receipt of a copy of this order. No costs.
