Transfer Civil Miscellaneous Petition is filed under Section 24 of Code of Civil Procedure, pleased to withdraw the D.V.C.No.23 of 2025 on the file of the Learned Additional Mahila Court at Tiruvallur and transfer the same to the file of the Learned Mahila Court at Egmore at Chennai.
Prayer in CMP No.25689 of 2026: Petition filed under Section 151 of Code of Civil Procedure, pleased to grant an order of interim stay of all further proceedings in D.V.C.No.23 of 2025 on the file of the Learned Additional Mahila Court at Tiruvallur, pending disposal of this Transfer Petition. For Petitioner(s) : Mr.M.Rajasekar For Respondent(s) : Mr.G.Jeremiah C O M M O N O R D E R Heard
2. In Tr.C.M.P. No.1388 of 2025, the petitioner/wife seeks withdrawal of G.W.O.P. No.350 of 2025 from the file of the learned Principal District Judge, 2/7
Thiruvallur and transfer of the same to the file of the Family Court, Chennai.
3. In Tr.C.M.P. No.1132 of 2025, the petitioner/wife seeks withdrawal of D.V.C. No.23 of 2025 from the file of the learned Additional Mahila Court, Thiruvallur, and transfer of the same to the file of the learned Mahila Court at Egmore, Chennai.
4. The marriage between the petitioner/wife and the respondent/husband was solemnized on 16.09.2013 and two minor children were born out of the wedlock.
5. The learned counsel for the petitioner submits that the matrimonial dispute between the parties is already pending before the III Additional Family Court, Chennai, pursuant to the earlier order of transfer passed by this Court in Tr.C.M.P. No.6 of 2025, by which H.M.O.P. No.6 of 2024 was withdrawn and transferred to the III Additional Family Court, Chennai.
6. It is further submitted that while the matrimonial proceedings are pending before the III Additional Family Court, Chennai, pursuant to the earlier order of transfer passed by this Court, the respondent/husband has filed G.W.O.P. No.350 of 2025 on the file of the learned Principal District Judge, Thiruvallur, though the 3/7
custody of the minor children is with the petitioner/wife. Though the petitioner and the children were earlier residing within the jurisdiction of Thiruvallur, after the matrimonial dispute, the petitioner has shifted her residence to Chennai along with the minor children and is residing with the support of her parents. Insofar as D.V.C. No.23 of 2025 is concerned, the same was filed at a time when the petitioner was residing at Thiruvallur and the said Court had jurisdiction.
7. This Court has considered the submissions. When the matrimonial proceedings between the parties are already pending before the III Additional Family Court, Chennai, pursuant to an earlier order of transfer, it would be appropriate that the connected guardianship and domestic violence proceedings are also tried before Courts at Chennai, so as to avoid conflicting findings and to ensure a comprehensive and effective resolution of disputes. The balance of convenience and the interest of justice clearly favour the transfers sought.
8. Accordingly, Tr.C.M.P. No.1132 of 2025 and Tr.C.M.P. No.1388 of 2025 are allowed. D.V.C. No.23 of 2025 on the file of the learned Additional Mahila Court, Thiruvallur, is withdrawn and transferred to the file of the learned Mahila Court at Egmore, Chennai. G.W.O.P. No.350 of 2025 on the file of the learned 4/7
Principal District Judge, Thiruvallur, is withdrawn and transferred to the file of the learned Family Court, Chennai. The learned Additional Mahila Court, Thiruvallur and the learned Principal District Judge, Thiruvallur, shall transmit the entire records to the learned Mahila Court at Egmore, Chennai and the learned Family Court, Chennai, respectively, within three (3) weeks from the date of receipt of this order and the transferee Courts shall dispose of the matters in accordance with law, as expeditiously as possible, uninfluenced by any observations made in this order. Interim stay granted by this Court on 17.10.2025 in CMP.No.25689 of 2025 shall stand vacated and C.M.P. No.32491 of 2025 is closed. There shall be no order as to costs.
