ORDER

This Writ Petition has been filed seeking a direction to the respondents to reimburse the medical expenses incurred by the petitioner for himself and his wife's treatment to the tune of Rs.4,57,228/- along with interest within time stipulated by this Court.

2. Heard the learned counsels on either side. With the consent of both sides, the Writ Petition is taken up for hearing at the admission stage itself.

3. The learned counsel for the petitioner submitted that the petitioner and his wife are retired Head Master and Teacher respectively and they are getting pension for their livelihood as per the Tamil Nadu Pension Rules. He continued that due to their old age, they suffered illness and therefore, underwent surgeries and treatments in the hospital at Hosur and Tirupathi from 20.05.2021 to 28.06.2021 respectively, unfortunately, the petitioner's wife died on 28.06.2021. He further submitted that the petitioner and his wife were covered by the New Health Insurance Scheme of the Government of Tamil Nadu, since the petitioner's wife suffered illness of septic shock, which is __________Page 2 of 6

critical care, the same is covered by the New Health Insurance Scheme with a provision to avail assistance upto Rs.5,00,000/-, however, the third respondent has sanctioned only a sum of Rs.1.5 Lakhs out of 7 Lakhs, hence, the petitioner made an application to the third respondent for reimbursement of remaining amounts along with bills and documents, but the same was returned without any consideration and therefore, the present Petition has been filed.

Considering the facts and circumstances of the case, there shall be a direction to the second respondent to dispose of the petitioner's application dated 02.01.2023 and to settle the medical reimbursement of the petitioner, in accordance with law, if there is no other impediment in disbursing the same, within a period of eight weeks from the date of receipt of a copy of this order.

5. With the above directions, this Writ Petition is disposed of. There shall be no orders as to costs.
