ORDER

The petitioner, who was arrested and remanded to judicial custody on 08.05.2022 for the offences punishable under Sections 363, 365, 457, 380 of IPC altered to under Section 302, 120(b), 457, 392, 302(2 counts) of IPC, in Crime No.201 of 2022, registered on the file of the respondent police, seeks bail.

2. This is a successive bail petition. Earlier, this Court dismissed the bail petition in Crl.OP.No.13665 of 2025 dated 22.10.2025 based on the report submitted by the learned Trial Judge, on the ground that the case was posted for pending for examination of witnesses LWs.46, 50 and 51 and it was observed that the trial was likely to be concluded at the earliest. After a lapse of three months, the petitioner has once again filed the present bail petition.

The learned counsel for the petitioner submitted that, out of 64 witnesses, the case is pending for examination of LWs.46, 50 & 51 and thereafter seven official witnesses, including the Investigating Officers, namely LW.63 and LW.64 are yet to be examined. He further submitted that the petitioner has no previous case pending against him and though it is a case of murder, that the petitioner is in judicial custody from 08.05.2022. Hence, he prays to grant bail to the petitioner.

4. The learned Government Advocate (Crl.Side) reiterated the prosecution case and submitted that the petitioner is hails from Sikkim, and that if the petitioner is granted bail, he will hamper the investigation. Hence, he opposed to grant bail to the petitioner.

4. Heard both sides and perused the materials available on record.

5. Considering the submissions made by the learned counsel on either side, and after taking note of the stage of the case and also considering the long period of incarceration, that the petitioner hails from Sikkim, this Court is of 2/5

the view that the petitioner is entitled to be enlarged on bail, subject to certain conditions.

Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties each, for a like sum to the satisfaction of the learned IV Additional Sessions Judge, Chennai and on further conditions that: [a] the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity;

[b] the petitioner shall report before the Trial Court daily at 10.30 a.m., until further orders. [c] the petitioner shall not abscond either during investigation or trial;

[d] the petitioner shall not tamper with the evidence or witness either during investigation or trial; [e] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself, as laid down by the 3/5

Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560];

[f] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 B.N.S.
