ORDER
The petitioners apprehend arrest for the alleged offence under Sections 191(2), 296(b), 115(2), 140(3) and 351(2) of BNS and Section 4 of TN Prohibition of Harassment of Women Act, 2002, in Crime No.107 of 2025 on the file of the respondent police seeks anticipatory bail.
2. The allegation against the petitioners is that on 15.06.2025 at about 1/4
7.30 p.m., the defacto complainant viz., Selvapriya lodged a complaint stating that when she was at her home, a group of accused persons had assaulted the defacto complainant and dragged her outside from house and tied with a tree and beaten up her due to previous enmity. When the son of the defacto complainant intervened to protect her, he was also physically assaulted. Thereafter, the accused persons forcibly took her to Kaliyamman Temple in Kangukuppam, where she was again assaulted with wooden sticks, verbally abused her with filthy language and threatened her with dire consequences. Hence, a case has been registered.
3. This Court, earlier dismissed the anticipatory bail application of the petitioners twice in Crl.O.P.No.25276 of 2025, dated 23.09.2025 and Crl.O.P.No.17933 of 2025, dated 17.07.2025 and now the present anticipatory bail application has been filed.

Considering the facts and circumstances of the case and the fact that the occurrence was taken place as early as on 15.06.2025 and already six months over and that some of the co-accused viz., A2 and A4 already arrested and released on bail, I am inclined to grant anticipatory bail to the petitioners, subject to certain conditions.

Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance, within a period of fifteen (15) days from the date on which the order copy is made ready, before the learned Judicial Magistrate, Katpadi, on condition that the petitioners shall execute a separate bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties each, for a like sum to the satisfaction of the learned Magistrate concerned, and on further conditions: (a) If the petitioners fails to surrender before the concerned learned Magistrate within a period of fifteen (15) days from the date of receipt of a copy of this order, this order shall stand automatically cancelled;
(b) The sureties shall affix their photographs and left thumb impression in the application for surety ship (Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019]'. The learned Magistrate shall obtain a copy of any one of identify proofs to ensure their identity;
(c) The petitioners shall report before the respondent Police everyday at 10.30 a.m., for a period of three weeks and thereafter, as and when required for interrogation; K.RAJASEKAR, J.
ssi (d) On breach of any of the aforesaid conditions, the 3/4
learned Magistrate/Trial Court is entitled to take appropriate actions against the petitioners in accordance with law as if the conditions have been imposed and the petitioners released on anticipatory bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji v. State of Kerala [(2005) AIR SCW 5560];
(e) If the petitioners thereafter absconds, a fresh FIR can be registered under Section 269 of BNS Act.
