ORDER
The civil revision petition is filed challenging the order passed by the Trial Court partly dismissing the application filed by the petitioners seeking impleadment of revenue authorities.
2. The respondents 1 and 2 filed a suit for declaration of title and recovery of possession. The petitioners are defendants. The instant application has been filed seeking impleadment of revenue authorities namely respondents 3 to 5 and the finance company with which the petitioners said to have entered into a mortgage transaction. The Trial court, by impugned order, allowed the impleading application with regard to the finance company. As far as prayer for impleadment of revenue authorities is concerned, the impleading application was dismissed. Aggrieved by the same, the petitioners have come before this Court.
3. The learned counsel for the petitioners submitted that the suit property is classified as a 'grama natham' and the petitioners' name had been entered in
the revenue records and therefore, the revenue authorities shall be impleaded in the present suit for the purpose of production of revenue documents.
4. If the petitioners want to prove their possession or their right over the suit property by relying on the revenue documents, it is for them to get the certified copy from the revenue authorities and produce it before the Court. Instead of following the said procedure, it is not open to the petitioners to insist that revenue authorities shall be impleaded in the suit.
5. The main suit filed by the respondents 1 and 2 is for declaration of title and recovery of possession. The rival contentions of the parties shall be proved by leading independent evidence. The presence of revenue authorities is not at all required in the dispute between the petitioners and the respondents 1 and 2. Therefore, I do not find any error in the order passed by the Trial Court partly dismissing the application seeking impleadment of revenue authorities.
6. Accordingly, the civil revision petition stands dismissed. Consequently, the connected miscellaneous petition is closed. No costs. 02-01-2026 Index:Yes/No Speaking/Non-speaking order Internet:Yes nr
