THE HONOURABLE MR.JUSTICE K.RAJASEKAR CRL OP NO.1145 of 2026 Eko Nathaniel Chibuzor Petitioner(s) Vs The State Represented by The Inspector of Police F-5, Choolaimedu Police Station, Chennai.
Crime No.37 of 2025.
Respondent(s) PRAYER : Criminal Original Petition filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023, to enlarge the petitioner on bail in the event of arrest in Crime No.37 of 2025 on the file of the respondent police.
For Petitioner(s):
Mr.Mohameed Aasif For Respondent(s):
Ms.J.R.Archana Government Advocate (Crl.side)
ORDER
When the matter was taken up for hearing, the learned Government Advocate (Crl.Side) submitted that the petitioner had already been released on bail by this Court in Crl.OP.No.9280 of 2025 dated 28.03.2025. Since the petitioner failed to comply with the conditions imposed while granting bail, the bail was cancelled by order dated 13.10.2025 passed by the Principal Special Court under EC & NDPS Act, Chennai - 104.
2. Considering the fact that the petitioner has already been arrested and released on bail, and that his bail was subsequently cancelled by order dated 13.10.2025 in Crl.MP.No.5550 of 2025, this Court is of the view that the petitioner has to challenge only the order of cancellation. Therefore, the present petition seeking anticipatory bail at this stage is not maintainable.
3. Accordingly, this Criminal Original Petition is dismissed, with liberty to the petitioner to challenge the order of cancellation, in accordance with law.
