Prayer:- Writ petition filed under Article 226 of the Constitution of India praying for issuance of a writ of Mandamus, "direct the 1st respondent to pass final order U/s. 6-A of E.C. Act or return back the said fertilizer bags by fixing the value of the fertilizer to the petitioner by receipt of the cost and pass such further or other orders as this Hon'ble Court may deem fit and proper in the circumstances of the case and thus render justice. 1/4

O R D E R

The above Writ Petition has been filed for the following reliefs:- "direct the 1st respondent to pass final order U/s. 6-A of E.C. Act or return back the said fertilizer bags by fixing the value of the fertilizer to the petitioner by receipt of the cost and pass such further or other orders as this Hon'ble Court may deem fit and proper in the circumstances of the case and thus render justice."

The main grievance of the petitioner is that, despite an enquiry having been conducted in the proceedings initiated by the 1st respondent under Section 6-A of the Essential Commodities Act as early as in the month of August 2025, and despite a representation having been made on 17.11.2025 requesting the 1st respondent either to pass final orders under Section 6-A of the Essential Commodities Act or to return the seized fertilizer bags to the petitioner by fixing the value of the fertilizers, as the seized fertilizers are perishable in nature and deteriorating day by day, no final orders have been passed by the 1st respondent to date. 2/4

3. Heard the learned counsel on either side and perused the records.

4. Taking into consideration the perishable nature of the seized goods, the Writ Petition is allowed with a direction to the 1st respondent to pass orders on the representation of the petitioner dated 17.11.2025, on merits and in accordance with law, within a period of two weeks from today. Since the order is passed in the presence of the learned counsel appearing for the 1st respondent, the 1st respondent shall not insist upon a certified copy of this order. No costs.
