When the respondents herein had sought for regularization of their services before the Writ Court, the learned Single Judge had placed reliance on the decision of the Hon'ble Full Bench in a Rev. Applc. (MD) No.87 of 2014 in W.A.(MD) No.729 of 2013 dated 30.05.2017, and had allowed the Writ Petitions vide orders passed in W.P.No.23667 of 2017, dated 01.09.2017, W.P.Nos.24590, 24591, 24594, 24612 and 24613 of 2017, dated 13.09.2017, W.P.Nos.22935, 21308, 22933, 19651, 21308, 22688, 22690, 24054, 18274, 22934 and 24055 of 2017 dated 07.09.2017, W.P.Nos.23467, 23468 and 23469 of 2017 dated 31.08.2017, and W.P.No.23809 of 2017, dated 04.09.2017. As against the said orders, the above appeals have been filed.

2.Mr.S.Gopinath, the learned Standing Counsel for the Corporation

submitted that as against the decision of the Full Bench, dated 30.05.2017, an appeal has been preferred in S.L.P.(C) No.19874 of 2017 and the Hon'ble Supreme Court had also stayed the proceedings. According to the learned counsel, the above appeals warrant interference, since the Writ Court had allowed the Writ Petitions only on the basis of the decision of the Full Bench, which has now been stayed. 3.These appeals were consistently being listed from the year 2019 and several of its adjournments were on the ground that the appeal is pending before the Hon'ble Supreme Court against the Full Bench's decision. In our view, no adjudication can take place in the Writ Appeals in view of the pendency of the case before the Hon'ble Supreme Court. However, if the Writ Appeals are closed granting liberty to the appellants to work out their remedies subject to the final out come of the Hon'ble Supreme Court and protect the limitation period for preferring the appeal also, the ends of justice could be secured.

4.Accordingly, without going into the merits, these appeals stand

closed granting liberty to the appellants to file appeals if required, within a period of 30 days from the date of receipt of the final judgment of the Hon'ble Supreme Court in S.L.P.(C) No.19874 of 2017. 5.In view of the dismissal of the Writ Appeal, the Management shall forthwith disburse all the retirement and pensionary benefits to the respondents, at least within a period of four (4) weeks, from the date of receipt of a copy of this order. The Management is also at liberty to deduct the workman's contribution towards the Provident Fund out of the retirement benefits. No costs. Consequently, connected miscellaneous petitions are closed.
