ORDER
(Judgement of the Court was delivered by S.M.Subramaniam J.) The State preferred the Review Application on the ground that the facts, in respect of the writ order referred, is distinct and different and not applicable to the respondents herein.
2. The Writ Court directed the Department to follow the earlier order, in so far as the petitioners are concerned, and pass orders within a period of three months, provided if the facts are identical. The Writ Court has not 2/5
elaborately adjudicated the individual facts of the respondents, who all are seeking appointment / regularisation in the post of Gang Mazdoor.
3. It is needless to state that while verifying the factual aspects between the candidates, the Department has to find out the eligibility under the Government Order and the Rules in force. The Writ Court has directed to follow the earlier order and pass appropriate orders within a period of three months. The State is at liberty to ascertain the factual details of the respondents and their eligibility and accordingly, follow the earlier orders, if the respondents are otherwise eligible and qualified for absorption.
