Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a writ of certiorarified mandamus to call for the records pertaining to the impugned proceeding in Moo.Mu.1404/2024/A3 dated 16.04.2025 of the Revenue Division Officer, Namakkal, the 2nd respondent herein and quash the same with the consequential directions to the respondents 1 to 3 herein to issue fresh legal heirship certificate to the petitioners after taking into account the Aadhar Card, Ration Card and the Voter ID of the 2nd petitioner herein. ORDER
This Writ Petition has been filed for the following relief: "To issue a writ of certiorarified mandamus to call for the records pertaining to the impugned proceeding in Moo.Mu.1404/2024/A3 dated 16.04.2025 of the Revenue Division Officer, Namakkal, the 2nd respondent herein and quash the same with a consequential direction to the respondents 1 to 3 herein to issue a fresh legal heirship certificate to the petitioners after taking into account the Aadhar Card, Ration Card and the Voter ID of the 2nd petitioner herein."

2. It is stated that the details of the legal representatives of the late Marappa Gounder, the husband of the 1st petitioner and the father of the 2nd petitioner and the 5th respondent were furnished by the 5th respondent. In the legal heirship certificate, the name was wrongly shown as "Karupayee, W/o. Palaniappan" instead of "Pappayee, W/o. Palaniyappan". This mistake came to the notice of the petitioners only very recently, as both of them are illiterate and it was the 5th respondent who had taken care to obtain the certificates after the death of their father.
3. On the last occasion, i.e on 19.11.2026, this Court had directed the learned Additional Advocate General to produce the original files relating to the legal heirship certificate.
4. Today, it is informed that, in view of the demarcation of the Taluk, the files could not be traced. However, since the 3rd respondent is the authority within whose jurisdiction the petitioners, the 5th respondent as well as the deceased Marappa Gounder were residing, the Writ 3/5
Petition is disposed of with the direction to the 3rd respondent to conduct an enquiry and verify as to whether the 2nd petitioner is the daughter of deceased Marappa Gounder and whether her name has been wrongly shown as Karupayee in the legal heirship certificate dated 22.03.2018 and to pass appropriate orders within a period of four weeks from the date of receipt of a copy of this order.
