Respondent PRAYER Writ Petition has been filed under Article 226 of the Constitutionof India praying to issue a Writ of Mandamus directing the respondent-Tamil Nadu Wakf Board, to Consider the petitioner's representations dated 06.08.2025 and 05.12.2025 and to conduct an enquiry under Section 63 of the Wakf Act and pass appropriate orders for appointment of a hereditary Muthawalli to the "Hajari Kulimbi Sahiba Charity Wakf", Triplicane, within a time frame fixed by this Honourable Court.

ORDER

The writ petition is filed with a prayer to consider the petitioner's representations dated 06.08.2025 and 05.12.2025.

2.Upon hearing the learned counsel appearing for the petitioner and perusing the said representations, it can be seen that the petitioner is claiming office of the hereditary Muthawalli through the said representations. 3.The learned counsel appearing for the respondent/Waqf Board submits that if everything is left open, the waqf Board will consider the representation on its own merits and pass orders in accordance with law. 4.In view thereof, the Writ Petition is disposed of on the following terms: (i)Both the representations dated 06.08.2025 and 05.12.2025 shall be taken up for consideration by the respondent-board, after due issuance of notice to the petitioner or any other person, who may be interested, as the waqf board may deem fit.

(ii)The enquiry into the representations shall be concluded and final orders shall be passed in accordance with law. (iii)The above said exercise shall be completed within a period of eight weeks from the date of receipt of a web copy of the order, without waiting for the certified copy of the order. No costs.
