ORDER
This Writ Petition has been filed seeking a direction to the respondents to consider the petitioner's representation dated 04.04.2025 claiming arrears of salary from the date of promotions to the promotional posts in the light of order passed by the Karnataka, High Court in the case of Commissioner, Karnataka Housing Board vs C.Muddaiah reported in (2007) 7 Sec.669 and also in Union Territory of Dadva and Nagar Haveli, V.Gulabhia M.Lad, reported in (2010) 5.SCC 775.
2. Mr.R.U.Dinesh Rajkumar, learned Additional Government Pleader takes notice on behalf of respondents.
3. Brief facts that are necessary for disposal of this Writ Petition are as follows:- The petitioner was initially appointed as Junior Assistant on 09.02.1984. Subsequently, his promotion to the post of Assistant was denied by the respondents while his juniors in the cadre of Junior Assistant were promoted. The said denial was
on the ground that the petitioner has not completed one year Taluk Training and 35 days of Survey Training as on 15.03.1988 due to which, there was a consequential delay in his subsequent promotions as well resulting in monetary loss to the petitioner. Therefore, the petitioner submitted a representation dated 04.04.2025 to the respondents seeking arrears of pay in respect of the promotional posts that were granted to him belatedly not in par with the similarly placed employees in the same cadre. However, no action has been taken on the same till date. Hence, the present Writ Petition.
4. Learned counsel appearing for the petitioner submits that it would suffice if this Court issues a direction to the respondents to consider the petitioner's representation dated 04.04.2025 and pass orders on the same on merits within the time that may be stipulated by this Court.
5. On the above contention, this Court heard the learned Additional Government Pleader appearing for the respondents.
6. In view of the limited relief sought for by the petitioner, this Court without expressing any opinion on the merits of the case, directs the 2nd respondent to consider the petitioner's representation dated 04.04.2025 and pass appropriate orders on the same on merits and in accordance with law within a period of six (6) weeks
from the date of receipt of a copy of this order after affording an opportunity of personal hearing to the petitioner and to any other interested parties.
7. The Writ Petition stands disposed of with the aforesaid direction. There shall be no order as to costs.
