Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus calling for the records relating to the proceedings of the 2nd respondent in Proceedings No.36136/BN2/2025 dated 17.10.2025 and quash the same and consequently, direct the respondents to retain the petitioner in the 3rd respondent University or in the alternative, accommodate the petitioner in any nearby institution in and around Chidambaram.

ORDER
This writ petition is filed to call for the records relating to the proceedings of the 2nd respondent in Proceedings No.36136/BN2/2025 dated 17.10.2025 and quash the same and consequently, direct the respondents to retain the petitioner in the 3rd respondent University or in the alternative, accommodate the petitioner in any nearby institution in and around Chidambaram.
2. By consent of both the parties, this writ petition is taken up for final disposal at the admission stage itself.

The case of the petitioner is that she was initially appointed as Assistant Matron in the third respondent University in the year 2001and thereafter, by proceedings dated 03.11.2006, she was appointed as Technical Assistant. This being so, the second respondent issued a proceedings No.36136/BN2/2025 dated 17.10.2025, transferring 92 surplus NonTeaching Technical Staffs to the existing vacancies and the petitioner is also one among them. Challenging the said proceedings, the petitioner has come forward with the present writ petition.

Learned counsel for the petitioner would submit that the petitioner is the primary caregiver of her aged parents with benchmark disability of 60% (permanent) and she has also having two school going children. However, without considering all those aspects and the binding Government Order in G.O.(Ms).No.107, dated 03.09.2020, which provides exemption from routine transfers to government employees, who are caregivers of persons with benchmark disabilities, the second respondent passed the impugned order.
5. Learned counsel for the petitioner would further submit that this 3/6
Court may permit the petitioner to join the transferred place i.e., Government Polytechnic College, Purasaiwakkam, Chennai and grant liberty to make fresh representation for re-transfer.
6. Heard the learned counsel for the petitioner and perused the materials available on record.

In view of the above submission made by the learned counsel for the petitioner, this Court without interfering with the order impugned dated 17.10.2025, grants liberty to the petitioner to make fresh representation for re-transfer, after joining the re-deployed post. On such representation, the authority concerned is directed to consider the same and pass appropriate orders on merits and in accordance with law.
With the aforesaid direction, this writ petition stands disposed of. No costs. Consequently, connected miscellaneous petitions are closed. 05.01.2026 vm Index : Yes/No Speaking order : Yes/No NCC : Yes/No 4/6
