ORDER

The present Criminal Original Petition has been filed seeking to quash the proceedings pending against the petitioners in C.C.No.2796 of 2025 on the file of the learned Judicial Magistrate No.VI, Coimbatore.

The case of the prosecution is that the accused, by fabrication of documents, pledged fake jewellery, availed a loan from the finance company and thereby, cheated the said finance company. 3.

The learned counsel for the petitioner submitted that the petitioner, who is arrayed as A5, is the wife of A4 and has no role in this case whatsoever in the alleged offence. He further submitted that her documents were misused by the other accused and that the petitioner has already deposited a sum of Rs.2,50,000/- before the Court.

Per contra, the learned Government Advocate (Crl.Side) appearing for the first respondent submitted that there are sufficient materials on record to show that the petitioner conspired with the other accused and by producing fabricated documents, obtained the loan. He further submitted that the question as to whether the petitioner had knowledge of the alleged acts or not is a matter for trial and that the proceedings cannot be quashed insofar as the petitioner is concerned.

5.At this juncture, the learned counsel for the petitioner seeks permission of this Court to withdraw the petition and also made an endorsement to that effect. Further, he sought the indulgence of this Court, to dispense with the personal appearance of the petitioner before the trial Court.

In view of the submission and the endorsement made by the learned counsel appearing for the petitioner, this Criminal Original Petition is dismissed as withdrawn. Consequently, the connected miscellaneous petitions are closed. However, acceding to the request made by the learned counsel for the petitioner, the personal appearance of the petitioner before the trial Court is dispensed with, except for receipt of copies, answering the charges, questioning under Section 313 Cr.P.C., passing of judgment, or any other date as may be required by the trial Court. The petitioner shall be duly represented by her counsel before the trial Court.
