ORDER

This petition has been filed to relax the condition imposed by this Court in Crl.M.P.No.7609 of 2019 in Crl.A.No.6 of 2019 dated 17.06.2019 that the petitioner shall appear before the trial Court once in three months commencing from the first working day of September, 2019 pending appeal. 2.The learned counsel for the petitioner submitted that the petitioner, who is a Senior Citizen aged about 77 years, had undergone open heart 2/4

surgery in the year 2011. Now the petitioner's health has deteriorated and he requires medical care and hospital visits. Hence, the petitioner is facing difficulty in complying the condition. Further the petitioner has been regularly appearing before the trial Court. Hence, prays to relax the condition. 3.The learned Special Public Prosecutor appearing for the respondent police submitted that the petitioner is complying with the conditions diligently.

4.Considering the fact that petitioner is aged about 77 years having health ailments and the submission made by the learned Special Public Prosecutor that the petitioner has been complying with the conditions diligently, the condition imposed on the petitioner to appear before the trial Court once in three months pending appeal, is totally relaxed. All other conditions remain unaltered.
