Respondent PRAYER : This petition has been filed under Section 528 of BNSS, 2023 to relax the condition that " the petitioner shall appear once in two weeks viz.,Monday at 10.30a.m., until further orders, imposed by this Court vide order dated 18.03.2025 in Crl.MP.No.5010 of 2025 in Crl.OP.No.32161 of 2024.

ORDER

This Criminal Miscellaneous Petition has been filed to relax one of the conditions imposed by this Court in Paragraph No.3 of the order in Crl.MP.No.5010 of 2025 in Crl.OP.No.32161 of 2024 dated 18.03.2025 that

the petitioner shall report before the respondent police once in two weeks viz., Monday at 10.30 a.m., until further orders;

2. The learned counsel for the petitioner submitted that the petitioner has duly complied the condition of this Court from 24.03.2025 for the past nine months and hence prays to allow this petition.

3. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and opposed to allow this petition.

4.Being satisfied with the reasons stated by the petitioner, this Court is inclined to modify the condition to the effect that '' the petitioner shall appear before the respondent police on every Tuesday at 10.30a.m., until further orders''. The other conditions imposed by the Court shall remain intact.

5. With the above modification, this Criminal Miscellaneous Petition is ordered.
