PRAYER : Petition filed under Section 5 of Limitation Act, to condone the delay of 746 days in filing the above writ appeal as against the order dated 20.10.2023 made in W.P.No.17273 of 2020.

(Order of the Court was made by R.SURESH KUMAR, J.) The delay is 746 days for which though some reasons have been stated at Paragraph Nos.16 & 17 of the affidavit filed in support of the petition and though we are not much satisfied with the said reasons, the learned Additional Government Pleader appearing for the petitioners has submitted that, apart from the reasons stated in the affidavit, some further administrative reasons also is attributable for such a huge delay of 746 days.

2. If the delay petition is allowed and the delay is condoned, certainly some prejudice would have been caused to the respondent / writ petitioner because of this long delay, which has to be compensated, therefore, we deem it appropriate to impose a cost of Rs.10,000/- (Rupees Ten Thousand only) 2/4

payable by the petitioners / appellants to the respondent / writ petitioner through the learned counsel for the respondent as a cost. Hence, such payment be paid by the petitioners / appellants to the respondent / writ petitioner through the learned counsel appearing for the respondent, within a period of two weeks from the date of receipt of a copy of this order. On such condition, this Civil Miscellaneous Petition is ordered.
