O R D E R

The petitioner seeks a direction to respondents 2 and 3 to consider the representation of the petitioners dated 03.11.2025 and adjust the excess Royalty amount paid by the petitioners for the year 2013 to 2018 with the 2/6

Royalty amount to be paid by the petitioners for the year 2020 to 2025 and to refund the excess Royalty amount to the petitioners.

The petitioners, who are the inland fishermen, are members of the fourth respondent Cooperative Society and fishing rights of the Barur Big Tank was leased out to the petitioners for the period between 2013 and 2018 under G.O.Ms.No.165, Animal Husbandry, Dairying and Fisheries Department, dated 25.09.2012 and the petitioners paid the royalty to the tune of Rs.63,45,600/-, but the royalty payable as per catch was only Rs.47,49,128/- and the petitioners were granted fishing rights again for the period from 2020 to 2025 and the petitioners have paid a royalty amount of Rs. 39,65,325/- as against the royalty to be paid by the petitioner of Rs.54,70,216.50. Now the petitioners wants to adjust the excess amount of Rs.

15,93,422/- lying with the respondent for the amount to be paid by the petitioners for the period 2020 to 2025 and refund the balance amount of Rs.88,530.50. Hence, the petitioners have sent representation dated 03.11.2025 to refund the balance royalty amount of Rs.88,530.50, after deducting a sum of Rs.15,04,891/- to be paid by the petitioners as royalty for the period 2020 to 2025. However, no orders have been passed by the respondents on the respondents till date. Hence, the petitioner is before this Court.

3. Mr.S.Rajesh, learned Government Advocate accepted notice for Respondents 1 to 4 and Mr.V.Jeevagiridharan, learned Additional Government Pleader accepted notice for fifth respondent.

4. The learned Government Advocate submitted that the representation of the petitioners will be considered and orders will be passed.

5. In view of the limited relief sought for by the petitioners, this writ petition is disposed of directing the respondents to consider the representation of the petitioners dated 03.11.2025 and pass orders on merits and in accordance with law within a period of two months from the date of receipt of a copy of this order.
