This application has been filed to sue the Respondent / Defendant in the above suit in respect of Schedule B Property.

2. According to the applicant, he is the plaintiff who filed a suit for partition and permanent injunction. Most of the properties are situated within the jurisdiction of this Court and the substantial cause of action arose within the jurisdiction of the case. One of the schedule mentioned property viz., Schedule B for which the prayer for partition sought for partition is beyond the jurisdiction of this Court and hence prayed to grant leave to sue the respondent / defendant in respect of 'B' Schedule property. https://www.mhc.tn.gov.in/judis

3. Heard the learned counsel for the applicant.

4. Considering the reasons stated in the affidavit filed in support of this application and considering the substantive part of the cause of action has arisen within the jurisdiction of the Court and 'B' Schedule property is beyond the jurisdiction of the Court and the relief sought for in the petition, this application is ordered.
