Respondent(s) PRAYER; This writ petition is filed under Article 226 of Constitution of India, to issue a Writ of Mandamus, directing the 1st Respondent to pass orders on the Appeal Petition submitted by the Petitioner dated 03.06.2023 against the order of punishment of removal from service passed by the 2nd Respondent in Procs No.No.M-I/HR/DAC/278-02/202301111650/2023 dated 06.05.2023 and to reinstate the petitioner into service in Neyveli Lignite Corporation India Limited, with all consequential and other attendant benefits, within a time frame to be fixed by this Honble Court.

ORDER

This petition has been filed seeking a direction to the 1st Respondent to pass orders on the Appeal Petition submitted by the Petitioner dated 03.06.2023 against the order of punishment of removal from service passed by the 2nd Respondent in Procs No.No.M-I/HR/DAC/278-02/202301111650/2023 dated 06.05.2023 and to reinstate the petitioner into service in Neyveli Lignite Corporation India Limited, with all consequential and other attendant benefits, within a time frame to be fixed by this Honble Court.

2. It is the case of the petitioner that he was initially appointed as Junior Engineer in NLC on 15.11.1996. On 22.09.2021 he was suffered a stroke due to brain haemorrhage resulting in coma and prolonged unconsciousness. He remained bedridden for an extended period and suffered paralysis of both upper and lower limbs, for which, he could not attend office regularly. For unauthorised absence, disciplinary proceedings were initiated and a charge memo was issued and an enquiry was concluded culminating in an order of removal from service dated 06.05.2023 without affording a proper personal hearing. Challenging the said order, the petitioner preferred appeal on 03.06.2023 seeking sympathetic consideration and the same is pending till date. Hence, the petitioner made a representation on 15.09.2025 and 25.10.2025 to dispose the appeal filed by the petitioner and the same is not considered. Hence, the present writ petition.

3. The learned counsel for the petitioner submitted that this Court may direct the respondents to consider and pass orders on the petitioners representation dated 25.10.2025 within the stipulated time as fixed by this Court.

4. Heard the learned the learned counsel for the petitioner and perused the materials available on record. Since no adverse order is passed against the respondents, notice to them is dispensed with.

5. Considering the facts and circumstances of the case and in view of the limited request sought for by the petitioner, this court directs the first respondent to consider and pass orders on the petitioner's representation dated 25.10.2025 and dispose the appeal filed by the petitioner within a period of twelve weeks from the date of receipt of a copy of this order.

6. With the above directions, the writ petition is disposed of. Consequently, connected miscellaneous petition is closed. No costs.
